1. Overview
This website, exauoliveoil.com, is operated by Olive Oil Distributors LLC, doing business as EXAU Olive Oil ("EXAU," "we," "us"), a premium olive oil brand based in Austin, Texas. On it, we sell our extra virgin olive oils, the Olive Oil Club, books, candles and other goods, and we publish recipes, olive oil education, and travel content mostly about Italy. These Terms apply to everyone who visits or uses the site, buys from us, or joins the Olive Oil Club. Our Privacy Policy, Refund Policy and Shipping Policy are part of these Terms.
2. Eligibility
You must be at least 18, or the age of majority where you live, to buy from us.
3. Orders and pricing
Prices are in the currency shown at checkout. Shipping and any sales tax are shown at checkout, and import duties are included. Prices, products and availability may change at any time without notice. Placing an order is an offer; we accept it when we ship. We may refuse, limit or cancel any order, for example for a pricing or description error, suspected fraud or bots, or stock we no longer have. We only keep payment for orders we ship: if we cancel an order ourselves after charging you, you get back what you paid. Product photos and colors on screen may differ slightly from what arrives.
4. Pre-orders and waitlists
Pre-order items ship within the timeframe shown on the product page, and we'll email you when yours ships. If we can't ship within that time, we'll email you and you can choose to wait or cancel for a full refund. Joining a waitlist is not an order and does not reserve stock.
5. Olive Oil Club
Club memberships renew automatically at the frequency you chose when you signed up (shown in your account), and we charge your payment method on file until you cancel. You can cancel any time in My Account or by emailing hello@exauoliveoil.com. Please cancel at least 2 days before your renewal date: on the renewal date itself, your order may already be charged and shipped. We'll email you before each upcoming charge and before any price change. See our cancellation policy.
6. Gift cards, rewards and discounts
Gift cards have no cash value except where the law requires, and do not expire. Rewards points have no cash value, cannot be transferred, do not expire, and may be changed or ended with notice. One discount code per order unless stated otherwise. We may cancel orders that abuse promotions.
7. Shipping and shipping protection
We ship to the US, Canada, the UK and Australia. Delivery times are estimates, and orders to Canada, the UK and Australia can take up to 10 extra business days. We're not responsible for carrier delays once a package has shipped. Risk of loss passes to you on delivery. All customs duties and import taxes are included in our prices, so you won't be charged anything on delivery. Optional shipping protection may be added to your cart with its price shown, and you can remove it before checking out. It is a separate service with its own terms. See our Shipping Policy.
8. Returns and refunds
All sales are final. Because we sell food and other consumable goods, we cannot accept returns of any kind, for safety reasons. If something isn't right with your order, email hello@exauoliveoil.com and we'll review it case by case. Other than for damaged or lost shipments (see our Refund Policy), any refund, replacement or credit is at our sole discretion. Nothing in these Terms limits rights you have under consumer law that cannot be waived.
9. Product information
Each product is described on its product page, and that description is what you receive. Please read it before you buy, and follow the label and any warnings on the product itself. Content on our site and blog, including recipes and health information, is general information and not medical or nutritional advice.
10. Reviews and content you send us
When you post a review, photo or comment, or tag us on social media, you give us a non-exclusive, royalty-free, worldwide, perpetual license to use, display, reproduce and share it, with your name or handle, in any media. You confirm it's yours, truthful, and based on a real experience. We may remove content that is unlawful, offensive, off-topic or spam. If you send us ideas or feedback, we may use them freely without owing you anything.
11. Our content
EXAU and the EXAU logo are trademarks of Olive Oil Distributors LLC, and the EXAU logo is registered with the US Patent and Trademark Office (Reg. No. 6,270,786). Our photos, recipes, text and designs belong to us or our licensors. You may share links and use our content for personal, non-commercial purposes. Don't copy, scrape or republish it, or use our trademarks, without written permission. You may not use the site for anything unlawful, try to interfere with its security or operation, or use bots or automated tools to buy products or access the site.
12. Affiliates and wholesale
Our affiliate program and wholesale orders are governed by their own terms or by the platform used. Purchases on Amazon or other marketplaces are governed by that platform's terms.
13. Disclaimers
Except as stated in these Terms and as the law requires, the site and our products are provided "as is." We disclaim implied warranties to the fullest extent the law allows. Links to other websites are for convenience only; we aren't responsible for their content, products or practices.
14. Limitation of liability and indemnity
To the extent the law allows, we are not liable for indirect, incidental or consequential damages, and our total liability for any claim is limited to the lesser of the amount you paid us for the order giving rise to it or $100. This does not limit liability for anything that cannot legally be limited. If your breach of these Terms or of the law leads to a claim against us, you agree to cover our reasonable resulting costs, including legal fees.
15. Disputes and arbitration
If you have a problem, email hello@exauoliveoil.com first and give us 30 days to make it right. If we can't, any dispute will be resolved by individual binding arbitration under the American Arbitration Association's Consumer Rules, not in court and not as a class action. Small-claims court is always available to you. You can opt out within 30 days of your first purchase by emailing us with the subject "Arbitration opt-out."
16. Governing law
These Terms are governed by the laws of the State of Texas and the US Federal Arbitration Act, without regard to conflict-of-law rules. Subject to Section 15, the state and federal courts located in Travis County, Texas have exclusive jurisdiction, and you consent to venue there.
17. Copyright complaints (DMCA)
If you believe content on our site infringes your copyright, send a notice under 17 U.S.C. §512 to our designated agent: Skyler Mapes, Attn: DMCA, Olive Oil Distributors LLC, 2028 E. Ben White Blvd #240-2528, Austin, TX 78741; hello@exauoliveoil.com.
18. Changes and general terms
We may update these Terms at any time by posting a new version with a new date. Changes apply to orders placed after they're posted, and to club renewals after we've emailed you notice. If a provision is unenforceable, the rest still applies. If we don't enforce a right, that isn't a waiver of it. You may not transfer these Terms; we may transfer them to a successor business. We may suspend or end your access to the site if you break these Terms. We aren't responsible for delays or failures caused by events outside our reasonable control. These Terms and the policies they link to are the entire agreement between you and us.
19. Text messages
If we offer text messages and you opt in, you agree to receive recurring automated marketing and order messages at the number you provide. Consent is not a condition of purchase. Message frequency varies, and message and data rates may apply. Reply STOP to opt out or HELP for help. Full program terms will be shown when you sign up.
